Who is liable landlord?
Branting Wear Group AB, Släktäktsvägen 16, 622 65 Gotlands Tofta is liable landlord. As landlords, we are obliged to:
- send a written confirmation of your booking.
- give details of where the key can be retrieved in a timely manner.
- ensure that home matches the description.
- inform about important changes concerning the reservation.
- specify how to dispose the house upon arrival and departure.
When is a booking binding?
A booking is binding once the tenant has paid the booking fee.
When shall the rent, booking fee and deposit be paid?
You can cancel your booking without cost (in writing) within 24 hours of making your booking, so that you can make up your mind without worrying about someone else booking "your dates". Thereafter, the below conditions and the Rules for cancellation apply.
- The full rental amount will be charged to your credit card 60 days before your arrival.
- If you have chosen a Non-refundable option, the full amount will be charged within 7 weekdays from the booking date.
- If your booking is made 60 days or less before your arrival, regardless of cancellation option, the full rental amount will be charged in connection with your booking.
- The booking fee is 30% of the rental amount and is charged in connection with the payment of the rental amount.
- In some rare cases, for guests younger than 30 years, a deposit of 1800 SEK per person is to be paid in upon arrival at the house and will be refunded after the house is inspected by the landlord, i.e. to ensure that the rented property is in approved condition and that final cleaning is approved. This deposit fee is usually only applied in "unusual cases" during summer time.
What happens if the tenant doesn't pay on time?
If the full rent is not paid in time, the landlord has the right to cancel the booking. If the tenant fails to pay in time, it will be considered as a cancellation and the rules for cancellations will then apply.
Rules for cancellation
- Cancellations must be made in writing under the rules of the place that the reservation was made,i.e. either via external part (e.g. booking.com) or to visbyuthyrning.n.nu. Cancellation is not valid if made to someone else or posted directly to the house. The landlord must confirm the cancellation in writing or else the cancellation is not valid.
- If you cancel or modify your booking with 61 days or more before your arrival date, only 30% of the rental amount (the booking fee) will be charged.
- If your cancel or modify your booking with 60 days or less before your arrival date or in case of a no-show, the total price of the rental amount will be charged. If your card issuer, for any reason, denies the debit of your card, an invoice will be sent to your adress and our factoring partner will add a invoice fee.
- If you have booked with the payment term "Non-refundable", the total cost of the rental amount is always charged if you cancel.
What are the tenant rights?
If the landlord fails to provide housing in the promised condition or at the right time and are unable to offer a different house/apartment that differs insignificantly from the one booked, you have the right to terminate the booking. The landlord must then refund all payments and reimburse the tenant for proved and reasonable costs, net of the benefits the tenant may have had of the house/apartment.
Instead of terminating the booking, the tenant could ask for a reduced rent.
If the tenant has a complaint, they should be presented to the landlord within 2 days of your arrival. Any errors that occur during your stay, shall also be made within 2 days, so that the landlord gets a chance to correct the occurred error.
If a complaint is not made within the specified time, any reduction of the rent is not approved.
What are the tenant’s obligations?
The tenant must take care of the house and follow the rules, instructions, regulations and any applied Swedish laws. The tenant is responsible for any damage caused to the property and its contents through the tenant or the tenant's guest's negligence.
Note in particular that, given our close next-door neighbors, that we will not accept so-called Party gangs, nor are pets allowed to reside in the house. Smoking is not allowed in the house. Sleeping bags are not allowed in the beds, only proper sheets are allowed (sheets & towel sets can also be rented for a fee)
The tenant may not use the house for anything other than what was agreed upon the booking (i.e. recreation) and must not allow more people to stay overnight in the house or on the property/garden than agreed upon when booking.
The tenant must clean the house thoroughly before departure, regardless of number of days stayed in the house (final cleaning can also be ordered for a fee). If cleaning is not satisfactory before departure, the landlord will do the cleaning at the tenant's expense, charged retrospectively. Either by reduction of the deposit, by invoice, charged to credit card or by cash payment.
War, natural disasters, strikes, etc.
If the landlord is prevented, or only at an unreasonably high cost, can fulfill his obligations under this lease due to, for example, war, riots, extensive labor dispute, blockade, fire, environmental disaster, serious spread of infection or other circumstances the landlord does not control or could not foresee, the landlord is released from fulfilling his obligations under this lease and from the obligation to pay damages or repayment to the tenant due to the obligations under this lease not being fulfilled.
What happens if the landlord and the tenant cannot agree?
As a tenant you should, as first instance, always directly contact the landlord with any complaints.
If you do not agree, you can turn to Allmänna Reklamationsnämnden (Swedish National Board for Consumer Complaints). It consists of an impartial chairman and a number of representatives of tour operators and consumers.
